These Terms of Use (the "Terms") are a binding agreement between you and Sbomira Team ("we", "us", or "our") that governs your use of the Sbomira app and related services (the "Service").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Eligibility (17+)
You must be at least 17 years old to use the Service.
2) Privacy
Your use of the Service is subject to our Privacy Policy.
3) Accounts
If you create an account, you agree to provide accurate information (name/username/email), keep it updated, and protect your credentials. You are responsible for activity under your account to the extent permitted by law.
4) License to Use the Service
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes in accordance with these Terms.
5) Your Content
"User Content" includes text entries, photos, voice notes, tags, and metadata you create or upload. You retain ownership of your User Content.
You grant us a limited license to host, store, process, and display User Content only as needed to provide, maintain, secure, and improve the Service and to perform operations you request (such as generating outputs you initiate).
You represent you have rights and permissions to provide your User Content.
6) Acceptable Use
- Do not break laws or regulations.
- Do not violate others’ rights (privacy, publicity, intellectual property).
- Do not upload malware, bypass security, or disrupt the Service.
- Do not reverse engineer the app except where prohibited by law.
- Do not use the Service for harassment or abuse.
- Do not use the Service for unauthorized commercial purposes.
7) Photos / Faces / Biometric Information
We do not perform face recognition or biometric identification and do not create biometric templates. If photo processing is available, it is designed to be one-time for the output you request.
8) Optional Automated / AI-Assisted Features (If Available)
If the Service offers automated processing to help organize or transform content and you choose to use it, you authorize us to process the content you submit for that purpose as described in the Privacy Policy.
9) Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Service, users, or our rights.
10) Disclaimers
The Service is provided "as is" and "as available" to the maximum extent permitted by law.
11) Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability will not exceed the amount you paid to us for the Service in the 12 months before the event giving rise to liability, or USD $100 if you paid nothing.
12) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Sbomira Team from claims arising from your User Content, your use of the Service, or your violation of these Terms.
13) Governing Law; Binding Arbitration
These Terms are governed by the laws of the jurisdiction of Sbomira Team’s principal place of business (without regard to conflicts rules). Except where prohibited by law, disputes will be resolved by binding arbitration in that jurisdiction, in English, by a single arbitrator. The decision is final and binding.
Either party may seek injunctive or equitable relief for intellectual property matters.
14) Changes
We may update these Terms from time to time by updating the Effective Date above.
15) Apple iOS / App Store Additional Terms
If you downloaded the app from Apple’s App Store, the following applies:
- Agreement is with us, not Apple: These Terms are between you and Sbomira Team, not Apple Inc.
- Support: Apple has no obligation to provide maintenance or support.
- Warranty: Apple has no warranty obligations other than refunding the purchase price (if any) as required.
- Claims: Sbomira Team is responsible for product claims and IP infringement claims relating to the app.
- Compliance: You must comply with applicable laws (including export/sanctions laws).
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms.
